Brazil Allows Medical Cannabis Patients to Cultivate Cannabis at Home




On Tuesday 14th June, a five-judge bench in Brazil unanimously voted in favor of three patients seeking to cultivate medical cannabis at home for personal use. This has been perceived as a precedent for similar cases that might arise in the future. The five judges expressed faith that this would trigger the legislature to formulate laws that govern the home cultivation of cannabis.

The panel that was composed of judges from the Superior Court of Justice voted to allow the patients to grow and extract cannabis oil and used it for pain relief. Even though medical cannabis is legal in Brazil, the current Brazilian law does not allow any form of cannabis cultivation, and patients have to rely on imported cannabis products. It is believed that such legal and regulatory issues are a result of moral and religious dogma but lack a scientific basis. As the judges noted,

“Let us stop this prejudice, this moralism that delays the development of this issue at the legislative, and many times clouds the minds of Brazilian judiciary.”

President Jair Bolsonaro is however opposed to any form of legislation that will allow Brazilians to grow cannabis at home, not even for medical purposes. On June 11th this year, Brazilians held demonstrations to protest limitations on medical cannabis in the country.
