Is Weed Legal in Austria? Understanding Austria Cannabis and Marijuana Laws (2026)

Recreational cannabis is illegal in Austria. Prescription cannabinoid medicines and regulated low-THC hemp products operate under separate rules; neither creates a general right to possess or grow marijuana. Personal-use offences can qualify for diversion from prosecution, but that is different from legal possession.

Is Recreational Cannabis Legal in Austria?

No. Austria’s Narcotic Substances Act, the Suchtmittelgesetz (SMG), prohibits unauthorized possession, acquisition, production and supply of controlled cannabis. Under Section 27, the basic offence carries up to one year in prison or a fine of up to 360 daily rates. Where the conduct is exclusively for personal use, the maximum is six months or 360 daily rates. These are statutory maximums, not automatic sentences, and daily-rate fines depend on the offender’s circumstances.

More serious supply and trafficking offences attract different penalties. Austria does not have a lawful personal possession allowance comparable to countries that have legalized specified quantities. A threshold used to distinguish offences must not be read as permission to carry that amount.

What Does Therapy Instead of Punishment Mean?

Section 35 of the SMG requires prosecutors to provisionally withdraw qualifying personal-use prosecutions when the statutory conditions are satisfied, with a probationary period of one to two years. This can cover conduct for another person’s personal use where the accused obtained no benefit.

Health assessment and, when needed, agreement to health-related measures can form part of the process. However, the law contains exceptions to obtaining a medical opinion in certain personal-use cannabis cases, with previous proceedings relevant to that exception. It is therefore inaccurate to say everyone must undergo treatment, or that cooperating automatically guarantees dismissal.

This approach can avoid a conventional conviction in eligible cases. It does not legalize the underlying conduct, establish a retail market, or guarantee that every possession case will have the same outcome.

Can You Grow Cannabis at Home?

Section 27 expressly covers cultivation for the purpose of obtaining narcotics. The key issue is the purpose of cultivation, not simply whether a plant has flowered. The availability of seeds, cuttings or growing equipment does not establish permission to cultivate recreational marijuana. A supposed rule allowing cultivation until flowering is an unsafe description of Austrian law.

Medical production follows a separate framework. Section 6a reserves cultivation to obtain narcotics for medicine manufacture and associated scientific purposes to AGES or a purpose-created subsidiary in which AGES holds at least 75% of the shares. That institutional permission does not give patients a home-growing entitlement.

What Medical Cannabis Can Patients Obtain?

Austria permits specific cannabinoid medicines, but its prescription framework does not provide general access to cannabis flower. It also is not limited exclusively to factory-finished products. Section 14 of the Narcotic Substances Regulation makes exceptions for authorized medicinal products prepared from cannabis extracts and for delta-9-THC isolated from extracts at a standardized purity above 95% for pharmacy-compounded preparations. The latter is relevant to prescribed dronabinol.

Sativex is one example of an authorized THC/CBD medicine. Its Austrian patient leaflet describes treatment of certain adults with multiple-sclerosis spasticity who have not responded adequately to other medicines. A product’s authorization is specific to its indication and prescribing conditions; it is not evidence that cannabis treats every condition advertised by retailers.

Patients should establish the appropriate medicine, prescription requirements, pharmacy availability and reimbursement with their clinician and pharmacist. Registration, actual supply and insurance coverage are separate questions. Announced launches also require checking: Germany’s authorization of Vertanical’s Exilby does not by itself establish availability in Austrian pharmacies. The manufacturer’s June 2026 announcement described expansion plans, which should not be treated as a guaranteed Austrian launch date.

Are Hemp and CBD Products Legal?

The answer depends on the product and its intended use. Low THC content alone does not settle whether an item can be sold as food, a medicine, a cosmetic or a smoking product. In particular, a 0.3% hemp threshold is not universal authorization for every finished product.

For food, the AGES novel-food guidance explains that ingredients classified as novel require authorization and must comply with the Union list’s specifications and conditions. Traditional hemp foods and concentrated cannabinoid extracts should not be treated as the same category. Austrian courts have upheld findings that CBD-extract oils were unauthorized novel foods.

Calling an oil an aroma or technical product is not proof that it is lawful to market for consumption. Likewise, the presence of a product in a shop does not establish regulatory approval, medicinal benefit or suitability for a particular customer.

Where Can Smokable Hemp Be Sold?

The tobacco-monopoly rules are especially important for low-THC flower. According to Austria’s monopoly administrator, MVG, the Supreme Administrative Court clarified on November 21, 2024 that legal smokable hemp products are subject to tobacco taxation. Legislation subsequently created a temporary licensing route for qualifying existing hemp shops.

Eligible shops that were already operating predominantly in legal hemp-flower sales on January 10, 2025 can continue selling smokable hemp through December 31, 2028 with a valid MVG licence. This is a conditional transition, not unrestricted permission for any CBD shop to sell flower.

Licensed hemp shops must already obtain smokable hemp exclusively from approved wholesalers. Wholesale suppliers account for the relevant excise tax and set consumer prices; shop margins are regulated. These requirements apply during the transition rather than beginning only in 2029. MVG publishes a list of licensed shops, which is more useful for checking a retailer than relying on an old storefront listing.

Do Neighbouring Countries’ Reforms Change Austrian Law?

No. Legal changes in Germany, Czechia or Switzerland do not create an Austrian possession, cultivation or import exemption. Travellers should not assume that purchasing or possessing a product lawfully elsewhere makes carrying it into Austria lawful. For prescribed controlled medicines, confirm the applicable documentation and travel requirements before departure.

Austria’s current distinction remains clear: recreational marijuana is prohibited, medical access is through the applicable pharmaceutical framework, and hemp products face rules specific to their category. Any future reform should be assessed against enacted legislation and its effective date, rather than campaign proposals or anticipated changes abroad.
