What Are the Cannabis Licensing Requirements in New York? (2026)
New York cannabis licensing depends on the business activity, ownership structure, proposed location, and whether the relevant application window is open. The Office of Cannabis Management (OCM) administers the program, while the Cannabis Control Board (CCB) makes licensing decisions. A license category appearing in state law does not mean new applications for it are currently available.
Which Applications Are Open?
OCM’s current licensing page lists Processor Type 3 Branding and Type 3 Flower as the available new adult-use license applications, accepted year-round. General cultivator, processor, distributor, retail, and microbusiness applications from the window that closed December 18, 2023 remain organized in review queues. A queue position neither guarantees approval nor determines when a license will issue.
The branding license permits white-label agreements with licensed New York processors; it does not authorize handling cannabis or require a licensed New York premises. The flower license is for eligible cultivators packaging and branding their own flower products. It does not permit extraction or infusion.

Match the License to Your Business
- Cultivator: grows and prepares cannabis crops for the licensed supply chain.
- Processor: makes or packages products within its approved processing activities. Extraction, infusion, and branding are not interchangeable permissions.
- Distributor: supplies cannabis products wholesale to licensed retailers.
- Retail dispensary: sells to adults aged 21 or older and can deliver under the applicable delivery rules.
- Microbusiness: combines cultivation with at least one additional approved activity: processing, distribution, or retail sale.
OCM’s microbusiness overview describes this as a limited-scale business model. Canopy limits include 3,500 square feet indoors, 5,000 in mixed light, or 10,000 outdoors; a combination option allows 5,000 outdoors plus 2,500 in mixed light. A microbusiness needs the relevant authorizations for each activity and must follow restrictions connecting its cultivation and retail locations. It is not a general exemption from licensing requirements.
Ownership, Disclosures, and Location Approval
New York generally separates the supply and retail sides of its cannabis market. Review the True Parties of Interest (TPI) framework before accepting investment or signing management, branding, or revenue-sharing agreements. Indirect control and financial interests matter as well as names on the business registration. A contract can create regulatory interests even when it does not transfer shares.
The retail licensing overview calls for an established applicant business, eligible owners, and a compliant location. Retail applicants must provide the required municipal or New York City community-board notice, generally 30 to 270 days before filing the final application. A lease does not itself authorize cannabis operations.
Use OCM’s LOCAL map to examine municipal opt-outs and nearby retail locations. Under the April 2026 Public Convenience and Advantage guidance, ordinary retailer separation is 1,000 or 2,000 feet depending on municipal population. A PCA request can address certain retailer-to-retailer conflicts, but cannot waive school or house-of-worship restrictions.
PCA eligibility also has minimum separation and other conditions, including how long a conflicting dispensary has been open. It is a final application or amendment review: denial means the applicant cannot simply submit a replacement retail location under that application. Assess the address carefully before requesting this route.
Provisional Licenses and Fees
A provisional license does not authorize cannabis business operations. Under OCM’s September 2025 extension policy, covered CAURD and general retail provisional licensees have until December 31, 2026 to submit a complete post-selection application. This includes the provisional licenses already issued, expired provisional licenses covered by the policy, and those issued through December 30, 2025.
Submit the location and proof of control through New York Business Express, not email. A timely complete submission can continue through review after the deadline; missing the deadline can prevent progression to a final license.
The application and licensing fee schedule separates the nonrefundable application payment from the license fee:

Cultivation fees vary with canopy type and size. Qualified Social and Economic Equity applicants receive a 50% reduction in application and license fees. Eligibility must be established; neither a fee reduction nor an application payment guarantees licensure. Budget separately for property, construction, equipment, testing, insurance, staffing, and operating capital.
Showcase Events Require a Separate Permit
OCM now accepts Cannabis Showcase Event permit applications. These can authorize sales away from the usual retail premises at approved pop-ups and markets. Municipal approval is required, and applications generally must be complete 45 days before the event. A permit lasts no more than 14 consecutive days; a location can host these events for no more than 45 days per calendar year. Consumption within the event area and free cannabis giveaways are prohibited.
The current statute, revised August 7, 2026, allows a microbusiness authorized for retail, processing, and cultivation to fulfill those required roles for its event permit. A suitably authorized microbusiness can also participate as a cultivator or processor for another applicant. Cannabis sales must be made by the retail permit holder; event participation does not independently authorize every exhibitor to sell.
Taxes and Ongoing Compliance
New York replaced its THC-based potency tax on June 1, 2024. The current adult-use cannabis tax framework imposes a 9% distributor tax on sales or transfers to retailers and 13% retail tax on consumer sales. For microbusinesses and registered organizations selling directly to consumers, the distributor tax applies to 75% of the retail amount, separately from the retail tax.
Tax returns are quarterly, with payment due by the 20th of the month after quarters ending in February, May, August, and November. Maintain the registrations and records required for your role in the supply chain.
OCM’s renewal application requires submission online 60 to 120 days before expiration. The renewal includes a community impact plan, labor peace agreement evidence, employee information, and applicable municipal notice. A timely complete renewal permits continued operation while review proceeds under State Administrative Procedure Act section 401(2); it does not guarantee approval. Submit changes to license details through the amendment process.
Medical Cannabis and Personal Growing Are Separate
Medical cannabis manufacturing and dispensing operate through registered organizations under the medical cannabis statute. Adult-use home cultivation has been permitted since June 26, 2024. OCM’s home-growing guidance allows adults aged 21 or older three mature and three immature plants each, subject to a household maximum of six mature and six immature plants. Homegrown cannabis cannot be sold without the appropriate commercial authorization.
