Public Consumption Laws

For licensed patients, smoking and vaping outdoors in public or indoors at a workplace follow the same state restrictions as tobacco smoking, according to OMMA patient guidance. This is not a blanket public-use permission. Employers need not allow marijuana possession or use at work.

Home Cultivation

Licensed patients may grow six mature plants and six seedlings. The property must belong to the patient or the owner must give written permission. Plants must not be accessible to the public or visible from an adjacent street. OMMA’s home-grow guidance also prohibits residential extraction using butane, propane, carbon dioxide, or other potentially hazardous materials. Recreational growing is not authorized.

Medical Cannabis in Oklahoma

Medical Cannabis Program

Since January 1, 2026, recommending physicians must complete approved medical marijuana education and register with OMMA before issuing recommendations. The OMMA notice explains the requirement. A medical license by itself does not satisfy this additional registration step.

Qualifying Conditions

Oklahoma has no fixed qualifying-condition list. Recommendations remain a clinical decision, but the physician must meet the current OMMA authorization and education requirements. Eligibility does not establish that cannabis is effective for every condition.

Patient Registration

Patients apply to OMMA with the required physician recommendation and supporting documents. Standard resident licenses last up to two years; short-term resident licenses last up to 60 days. OMMA’s application page lists fees and document requirements. Approved patients may use their official OMMA approval email or MedPortal approval as alternative identification while awaiting the card, subject to dispensary verification.

Medical vs Recreational Differences

OAC 442:10-2-8 allows licensed patients to possess the following at one time:

  • One ounce of concentrate.
  • 72 ounces of edible marijuana and 72 ounces of topical marijuana.
  • Six mature plants and their harvested marijuana, plus six seedlings.

The product weights are not THC-dose recommendations. The previously proposed ten-milligram serving and 100-milligram package limits in SB 1591 should not be treated as enacted requirements: the bill history does not show passage into law.

Is CBD Legal in Oklahoma?

The deferred provisions include the new total-THC definition and the finished-product exclusion above 0.4 mg per container of combined THC and specified similarly acting cannabinoids under section 781. Existing local product rules remain applicable.

Cannabis-Derived CBD

CBD products derived from cannabis or containing higher THC levels are restricted to licensed medical dispensaries.

CBD Food and Beverage Laws

Oklahoma’s hemp retail provision preserves food-safety and licensing requirements. State hemp authorization does not establish FDA approval of CBD foods or supplements. The scheduled federal hemp definition change is a separate issue from those existing product rules; check both before relying on a retailer’s availability claims.

Future Cannabis Legislation in Oklahoma

HB 3143 extended the new-license moratorium to August 1, 2028, unless OMMA ends it earlier after completing the required pending reviews, inspections, or investigations. The moratorium covers new grower, processor, and dispensary licenses; existing licensees can seek renewal. OMMA’s implementing emergency rules took effect August 28, 2026.
