- Medical flower purchases: retailers may sell no more than 2.5 ounces, or 71 grams, of raw marijuana per patient every 14 days. This dispensing allowance is not a general possession rule.

Cannabis may only be purchased from state-licensed therapeutic marijuana pharmacies. There are no legal retail storefronts for recreational consumers in the state.
Public Consumption Laws
Medical access does not create unrestricted permission to use cannabis in public, at work, in vehicles, or on restricted property. Follow applicable location and smoking rules. The new school-zone offense described below requires an underlying controlled-substance violation; lawful medical possession should not be equated automatically with that violation.
Home Cultivation
Personal marijuana cultivation is prohibited. R.S. 40:1046 limits commercial production to two licensees. Since July 2024, those licenses have been held directly by the former university contractors, rather than by LSU and Southern University themselves.

Medical Cannabis Program
Louisiana’s authorized clinicians include licensed physicians, nurse practitioners with prescriptive authority, and medical psychologists in good standing. A bona fide clinician-patient relationship is required. Retailers need a specific clinician recommendation to supply raw flower to a patient younger than 21.

Cannabis Penalties and Restrictions
The ordinary small-possession penalties described above are not a complete account of exposure. Unauthorized production, distribution, repeat offenses, and other circumstances can carry more serious penalties. Impaired driving remains prohibited.
Act 305 took effect August 1, 2026. It covers underlying controlled-substance violations involving smoking, vaping, or otherwise abusing the substance on school property, within 2,000 feet, or on a school bus. For a covered marijuana-possession violation, the Act permits up to one year of imprisonment and an additional fine up to $1,000. The Act requires an underlying violation; it should not be summarized as automatically criminalizing all lawful medical use near a school.
Future Cannabis Legislation in Louisiana
Enacted changes already affect the program: production licensing shifted away from the universities in 2024, LDH assumed retail regulation in 2025, and the 2026 school-zone law changes potential penalties for covered unlawful conduct.
