Recreational cannabis remains illegal in the United Kingdom. Prescribed cannabis-based medicines have a separate legal route, while consumer CBD products must meet drug controls and the rules for their intended use. A prescription does not authorize home cultivation or sharing medicine with someone else.

Legal Age Requirements
There is no legal recreational purchase age or licensed adult-use retail market.
Possession Limits and Penalties
Cannabis remains a Class B drug. The government’s penalty guidance gives maximum sentences of five years for unauthorized possession and 14 years for supply or production, with an unlimited fine or both. Sharing can count as supplying, even without payment. These are maximums, not automatic sentences for a first offense.
There is no nationwide lawful personal-possession allowance. The response to a small quantity depends on circumstances, prior offending and local enforcement arrangements; a warning should never be assumed.
Public Consumption Laws
Recreational possession does not become lawful on private property. Prescribed treatment is different: lawful possession of medicine is not prohibited simply because the patient is outdoors. Follow the prescribed administration method and the relevant venue’s rules.
The medical-cannabis regulations prohibit smoking. That does not mean every medicine must be vaporized: oral preparations are also prescribed.

Medical Cannabis Program
For unlicensed cannabis-based medicinal products, treatment must be initiated by a doctor on the GMC Specialist Register. Other prescribers can continue treatment under the specialist’s direction. Licensed medicines have separate prescribing arrangements. “Unlicensed” describes a medicine’s marketing-authorization status; it does not mean a lawful prescription is illegal.
Qualifying Conditions
NHS guidance for England describes limited access, principally for certain severe epilepsies, chemotherapy-related nausea or vomiting, and multiple-sclerosis spasticity when other treatments have not helped or are unsuitable. Products include CBD liquid, capsules and an oral spray.
Private prescribing requires an individual clinical assessment. A clinic’s requirement to try two earlier treatments should not be presented as a universal statutory eligibility rule. A diagnosis alone does not guarantee a prescription or establish that cannabis will help. Discuss alternatives, interactions, side effects and ongoing review with the prescriber.
Medical vs. Recreational Differences
The police guidance on medicinal cannabis advises officers to check dispensing information and, where necessary, contact the prescriber before taking further action. Keep the original labeled packaging, a prescription copy and matching identification available to help establish lawful possession. The guidance explains that carrying a prescription copy or prescriber’s letter is not itself a legal requirement. A commercial cannabis card does not replace a prescription.
Use medicine exactly as directed. A prescription offers no permission to drive while impaired. In England, Scotland and Wales, the drug-driving framework distinguishes impairment from exceeding specified blood-drug limits and provides protections for medicines properly prescribed and taken as directed. Northern Ireland has a different framework; impaired driving remains unlawful. Ask the prescriber about driving before starting or changing treatment.
Is CBD Legal in the United Kingdom?
Pure CBD is not a controlled drug. A finished CBD product can nevertheless contain controlled cannabinoids or fall under medicines, foods or other product rules.
Hemp-Derived CBD
The Home Office factsheet explains that the exempt-product test has three conditions: the product must not be designed to administer the controlled drug; that drug must not be readily recoverable or recoverable in a quantity posing a health risk; and each controlled drug must remain within the applicable limit. For cannabinoids, the Home Office interprets that limit as 1 mg per container, not per serving. All three conditions matter.
A hemp cultivation percentage is not a retail CBD allowance. Growing cannabis requires the appropriate licence; a patient prescription or a seed advertised as low-THC does not supply one.
CBD Food and Beverage Laws
The FSA’s August 2026 guidance states that no CBD extracts or isolates have yet received novel-food authorization. In England and Wales, eligible existing products on its public list may remain pending an authorization decision. Listing or a validated application is not authorization, and does not permit launching new products.
Scotland’s food regulator has separate guidance. Northern Ireland follows the EU novel-food authorization framework; the FSA says there are currently no authorized CBD food products there. Do not treat the England-and-Wales list as UK-wide approval.
The FSA advises healthy adults to limit CBD from foods to 10 mg daily. This is precautionary consumption advice, not a universal criminal possession limit or a prescribed-medicine dose. It discourages use by vulnerable groups without medical direction, including children, people taking medicines, and those pregnant, breastfeeding or trying to conceive.
Where to Buy Cannabis in the United Kingdom
Licensed Cannabis Pharmacies
Obtain prescribed medicine through a pharmacy dispensing a valid prescription. Delivery may be available, but the law does not make specialist home delivery the only dispensing route. Confirm supply arrangements with the clinic and pharmacy. Retail CBD and products advertised online as medical cannabis are not substitutes for prescribed medicine.
