Is Weed Legal in Malawi? Understanding Malawi Cannabis and Marijuana Laws (2026)
Recreational cannabis is illegal in Malawi. The country permits regulated medicinal, scientific and industrial cannabis activities, but its 2020 reform did not create a recreational market or a personal home-growing allowance. Malawi’s reputation for the local variety known as Malawi Gold does not change those restrictions.
What Does Malawi’s Cannabis Law Allow?
The Cannabis Regulation Act 2020 establishes the Cannabis Regulatory Authority (CRA) and a system of licences and permits. Section 24 restricts activities including cultivation, research, possession, processing, import, export and distribution unless authorised under the Act or another law.
The Act defines industrial hemp using a delta-9 THC concentration of no more than 1% in plant material, subject to a different concentration being prescribed. It also separately defines medicinal cannabis as approved medicinal products. It is therefore misleading to describe the entire medical framework as simply permission for plants below 1% THC.
Is There a Medical Patient-Access Route?
Yes, the legislation provides one. Section 41 requires a valid registry identification card for medicinal use under the Act and provides for licensed clinics and hospitals to issue cards to qualifying patients and designated caregivers. Additional safeguards apply to patients under eighteen.
However, a statutory pathway is not proof that a particular clinic issues cards or that a particular medicine is stocked. Patients should ask CRA and their medical practitioner about currently authorised providers and products. An overseas medical card, prescription or online CBD listing should not be assumed to establish permission to purchase or import a product in Malawi.
Did the 2024 Chamba Bill Become Law?
Parliament passed a private member’s amendment bill in March 2024 intended to enable controlled cultivation of locally produced cannabis. Supporters expressly distinguished licensed cultivation from recreational smoking.
President Lazarus Chakwera subsequently withheld assent in June 2024, calling for further consultation. Passage by Parliament should not be reported as enacted legalisation. The sources reviewed for this guide do not establish subsequent enactment of that bill. Farmers considering local chamba varieties need explicit confirmation from CRA of what their licence permits; the 2024 parliamentary vote is not planting authorisation.
What Did the Court Decide About Religious Use?
On May 8, 2026, the High Court rejected James Magwira’s constitutional challenge concerning possession of cannabis for Rastafari religious purposes. The case, James Magwira v Attorney General [2026] MWHC 22, is listed by MalawiLII. Reporting on the decision confirms that the court upheld the restrictions against the asserted religious-freedom, equality and dignity challenges.
The ruling did not create a religious-use exemption. Nor does Malawi’s long history of cannabis cultivation create a recreational possession entitlement for residents or visitors.
Who Can Apply to Grow Cannabis?
CRA’s published licensing guidance identifies registered farmer organisations, corporate companies and corporate partnerships as eligible applicants, subject to the relevant requirements. It channels farmers through registered groups rather than individual recreational plots.
The guidance describes activity-specific licensing, including cultivation, processing, storage and distribution. Licences and research or laboratory permits generally last twelve months; import and export permits have a maximum four-month validity. Applicants should confirm the documents, premises requirements and renewal timetable directly with CRA before committing funds. A licence for one activity does not automatically cover the entire supply chain.
What Are the Revised Cannabis Licence Fees?
The 2024 amended fee schedule published by CRA replaces the older figures often quoted from the industry’s launch. The listed licence charges are in US dollars:

The schedule also contains separate hospital, pharmacy, research, testing and licence-amendment fees. Seed imports and exports of semi- or fully processed cannabis products are charged at 1.5% of consignment value. Obtain a current assessment for the specific activities proposed; the cultivation charge is not an all-inclusive project price.
Malawi Gold and the Export Opportunity
The reputation of Malawi Gold and proposals to earn foreign exchange have attracted attention to the industry. They should be separated from evidence of legal market access. A famous strain name does not prove a product’s composition, approval status or suitability for a medicinal market.
For a commercial project, check the authorised variety, buyer’s import permissions, testing specifications, processing needs and payment terms before planting. Announced investment, a licence granted and a completed export are different milestones. Practical Implications for Residents and Visitors
Do not assume cannabis is available for lawful recreational purchase because cultivation has been licensed or local cannabis is well known. For medical treatment, establish the authorised patient and supply route. For farming or trade, obtain the appropriate CRA approvals.
