Qualified medical patients have a separate five-ounce allowance. Non-cannabis ingredients in preparations do not count toward that statutory weight.

There is no recreational dispensary market. The Medical Cannabis Commission regulates the medical supply chain. Its manufacturing-license application period runs through September 14, 2026. Check directly with the Commission for licensed dispensary availability before planning a purchase; a hemp shop or a proposed cannabis business is not automatically a medical dispensary.

Recreational use has no state authorization. Medical businesses cannot allow consumption on their licensed premises. A medical recommendation also does not authorize driving or being in actual physical control of a vehicle while under the influence of a drug. Home Cultivation

Licensed Cannabis Dispensaries

The adopted dispensing rules allow tablets, capsules, tinctures, topicals, suppositories, patches, nasal sprays and specified inhaler/nebulizer preparations. They prohibit raw plant material, smoking/vaping products and infused food or drink. Limits include 60% total THC and 40 milligrams per dose.

Dispensing is limited to a prescribed 30-day supply, within the possession allowance, and five grams of total THC per patient over 90 days. Orders cannot be refilled; dispensing again within 30 days is prohibited. Pregnant patients cannot be dispensed cannabis under these rules.

On September 4, the Nebraska Supreme Court affirmed rejection of the petition-validity challenges in Kuehn v. Evnen. On September 11, it affirmed dismissal without prejudice of Kuehn v. Pillen for lack of standing. The latter ruling did not resolve the constitutional claims on their merits.
