Is Cannabis Legal in Wyoming

Cannabis is illegal in all its forms in the state of Wyoming. This state still has a number of the strictest marijuana laws in the U.S.

Wyoming passed laws prohibiting marijuana early on at the start of the 20th century, somewhere between 1913 and 1929. Though many states have since legalized or decriminalized recreational marijuana, the state of Wyoming has not.

Possession of less than three ounces (85 g) of marijuana in this state is a misdemeanor punishable by a fine of up $1000 and a maximum jail sentence of 1 year. Possessing more than three ounces is considered to be a felony.

Legalizing CBD oil in the state of Wyoming

The Wyoming chapter of NORML (the National Organization for the Reform of Marijuana Laws) in 2015 gathered signatures for the placement of the legalization of medical cannabis on the election ballot of 2016 as a ballot initiative. The state of Wyoming however has very stringent requirements for ballot initiatives which has led to not a single public initiative re reaching ballot in 21 years that is from 1991.

For three years in a row, legislation to decriminalize the possession of an ounce of or less of cannabis (28g) (sponsored by State Representative James Byrd of Cheyenne) failed to pass the Wyoming House of Representatives ending in 2016.

Supporters sought 25,000 signatures in 2017 to place on the 2018 ballot the Peggy A. Kelley Wyoming Cannabis Act of 2016 as a public initiative. However, they were unable to acquire the required signatures at the time of the deadline, February 14.

In 2021, a bill was filed by lawmakers that would legalize cannabis both for recreational and medical use. The bill however later died in the Wyoming House of Representatives after it was missing a deadline.

Finally in July 2015, the use of cannabidiol for the treatment of seizures was legalized. This law is however so narrow and has no provision for in-state access.

Though a majority of Wyoming residents support the legalization of marijuana for medical use, this is yet to be passed. However, effort by way of placing two initiatives on the ballot to decriminalize cannabis and legalize medical cannabis are being made.
