Meta Implements Changes to Hemp and CBD Advertising Policies

On July 11th, Meta Platforms, the company known for Facebook and Instagram, updated its advertising policy regarding hemp and CBD products. The new policy allows for the promotion of legally permissible, non-ingestible CBD products in the U.S., albeit with some restrictions. However, ads promoting THC products or cannabis products containing psychoactive components are still strictly prohibited under the full policy.

Without needing written permission, Meta advertisers can now promote or offer to sell hemp products without CBD or with less than 0.3% THC (such as hemp seed and hemp fiber) in Canada, Mexico, and the United States, as long as they comply with all relevant local laws and industry guidelines.

Notably, Meta continues to disallow advertisements promoting or offering to sell CBD or similar cannabinoid products, with one limited exception. U.S. advertisers can promote legally permissible CBD products only if they are certified by LegitScript and receive written permission from Meta. However, it's important to mention that LegitScript currently certifies only non-ingestible CBD products.

While Meta permits education, advocacy, and public service announcements related to CBD and related products, it is crucial that such ads do not promote or offer any prohibited products for sale. Ads related to social issues, elections, or politics will require a disclaimer.

Furthermore, Meta strictly warns that ads for CBD or hemp products must not make any claims of treating, curing, preventing, mitigating, or diagnosing diseases or medical conditions in humans or animals. Such claims are not allowed. Additionally, images depicting cannabis flower or cannabis oil are also forbidden according to Meta's help document.

It's worth noting that Meta's latest hemp and CBD policy follows Twitter's recent easing of cannabis industry advertising rules, which allows ads for THC products under certain circumstances. Google has also relaxed its restrictions on hemp and CBD advertisements.
