Is Weed Legal in Denmark? Understanding Denmark Cannabis and Marijuana Laws (2026)

Recreational cannabis remains illegal in Denmark. Personal possession can lead to a fine, and neither a small quantity nor a visit to Copenhagen’s Christiania creates a legal exemption. Medical access is different: Denmark made its medicinal cannabis programme permanent on January 1, 2026, alongside other prescription routes.

Is recreational cannabis legal in Denmark?

No. Denmark has no general adult-use cannabis market or personal home-growing allowance. Its medical programme does not authorize recreational purchases or sharing. The distinction matters for residents and visitors alike, including people arriving from countries with more permissive laws.

What are the penalties for cannabis possession?

The Director of Public Prosecutions’ April 2026 guidance gives these starting fines for personal possession:

These are sentencing categories, not legal possession allowances. Higher amounts, evidence of distribution and other circumstances can change the outcome. The older claim that a first offence normally costs about €70 substantially understates these starting figures.

Warnings are possible under specified conditions. The social-circumstances provision requires more than occasional cannabis use or a low income: it concerns possession connected with prolonged, strong dependence on hard drugs, together with qualifying social circumstances.

Serious trafficking may fall under section 191’s ten-year maximum. The guidance expressly excludes hash from the separate sixteen-year maximum for particularly dangerous substances. That higher figure should not be presented as the ordinary maximum for hash trafficking.

How does Denmark’s permanent medical programme work?

The Danish Medicines Agency confirms that the programme, introduced in 2018, became permanent on January 1, 2026. Its products are not fully approved medicines. Admission to the programme should not be read as proof that every product has established effectiveness for every condition.

Doctors may consider these products when relevant approved treatments have not produced satisfactory results. The agency’s guidance discusses nerve pain, cancer pain, multiple-sclerosis symptoms, spinal-cord-injury pain and chemotherapy-related nausea and vomiting. These are clinical considerations rather than an automatic entitlement to cannabis. Doctors retain prescribing discretion, must assess the individual patient and are not required to prescribe it.

Patients obtain prescribed products through a pharmacy. Product availability can change; the agency points patients and clinicians to Medicine Prices for current listings. A permanent legal framework does not guarantee that a particular flower or oil will always be stocked.

What other prescription routes are available?

The agency’s prescribing guidance distinguishes approved medicines, individually permitted imports, pharmacy preparations and programme products. Sativex is an authorized cannabis-extract spray prescribed by neurology specialists. Epidyolex is a CBD medicine for specified epilepsies, prescribed by neurology or paediatric specialists.

Unmarketed medicines such as Marinol or Nabilone require an individual compassionate-use authorization. A doctor can also prescribe a pharmacy-made preparation for a specific patient. These routes have different regulatory requirements; they should not be confused with buying an unlicensed CBD oil online.

How much reimbursement can patients receive?

Under the agency’s 2026 reimbursement rules, programme products have a separate reimbursement account. Eligible patients receive 50% reimbursement on the first DKK 20,000 of expenditure in a twelve-month reimbursement period. This means a maximum subsidy of DKK 10,000, with the full cost of further purchases paid by the patient.

Patients with a qualifying terminal-care reimbursement authorization receive 100% reimbursement. These special cannabis thresholds are separate from the ordinary medicine reimbursement scale. Patients should ask their pharmacy which scheme applies to their particular prescription.

Can you grow cannabis or buy CBD products?

There is no general permission to grow cannabis at home for personal medical or recreational use. A prescription is not a cultivation licence. Official agricultural guidance explains that cultivation is regulated whether the crop is intended for medicine or industrial hemp. Businesses need the relevant permission; industrial hemp is not a blanket exception to cultivation controls.

For finished products, the 0.2% THC exception removes qualifying products from the euphoriant-substances rules. It does not override medicine, food or cosmetics legislation. Conversely, a product above that threshold is controlled, but lawful medical supply remains possible under the relevant authorization.

The agency’s March 2026 product guidance says the legal CBD-containing products for oral use are prescription-only. There is no universal CBD concentration that makes every product a non-medicine: classification depends on its effects, presentation and intended use. A low THC percentage or a shop’s assurance does not establish that a CBD oil is lawful.

What should drivers and travellers know?

Danish police guidance sets out escalating consequences for driving with THC in the blood. The result depends on the measured concentration and circumstances. Patients should discuss driving restrictions with their prescriber and must not drive when impaired.

A foreign prescription does not authorize recreational purchases in Denmark. Before travelling with a controlled medicine, check the medicine-import rules effective from January 2026 and the requirements of any transit country. Carry documentation for the medicine and obtain the applicable travel certificate. Rules for ordinary medicines should not be assumed to apply unchanged to narcotic medicines.

Is Christiania a legal cannabis market?

No. Christiania’s open Pusher Street market was never a general legal retail exemption. Residents and public authorities began physically transforming the street on April 6, 2024. The local council marked the closure’s first anniversary in April 2025, and the Danish Crime Prevention Council recognized the project later that year.

The closure should not be interpreted as proof that illicit sales have disappeared everywhere. For a visitor, the practical point is that Christiania offers no legal protection for buying or possessing recreational cannabis.

Does medical reform mean recreational legalization?

No. Permanent medical access and a legal recreational market are separate policies. Proposals or debates about regulated sales do not change the law until the necessary legislation takes effect. Denmark’s rules also should not be inferred from those in Sweden, Norway or Malta, each of which has its own framework.
