Is Weed Legal in Estonia? Understanding Estonia Cannabis and Marijuana Laws (2026)
Recreational cannabis is not legal in Estonia. Unauthorized use and small-quantity possession can be misdemeanors, while more serious handling offenses fall under criminal law. Prescription medicines and qualifying agricultural hemp are separate categories; neither creates a general recreational market.
Is Cannabis Decriminalized in Estonia?
The term “decriminalized” can obscure what the law actually permits. Under Section 15¹ of Estonia’s narcotic-drugs act, consumption without a prescription and unauthorized manufacture, acquisition, or possession of a small quantity remain punishable. The statute provides for a fine of up to 300 fine units or detention.
The same act defines a large quantity as enough to cause intoxication in at least ten people. It does not set a universal lawful allowance of 7.5 grams of cannabis. Product potency and the legal assessment of the quantity matter. A commonly repeated gram figure should not be treated as permission to possess cannabis below that weight.
A misdemeanor is still an offense. Statements that police generally ignore users should not be relied on as a guarantee against investigation, confiscation, or punishment.
What Penalties Can Apply?
The adult fine ceiling of 300 units corresponds to €2,400 at the €8 fine-unit value introduced from January 1, 2025. The Riigikogu’s announcement of the enacted change explains the increase from the previous €4 unit and the separate treatment of minors. The maximum is not a standard fine automatically imposed in every case.
Distribution-related conduct and large-quantity handling can lead to criminal proceedings under the Penal Code. The relevant charge depends on the conduct and circumstances, not simply on whether the person says the substance was for personal use. It is misleading to describe every case as a fixed €800–1,200 fine.
For an actual charge, the current statutory provisions and the facts of the case matter more than comparisons with maximum sentences in neighboring countries.
What Happened to the Proposed Drug-Penalty Reform?
In January 2026, the justice ministry circulated a proposal to raise the large-quantity threshold from ten to thirty doses. ERR’s report described a draft intended to distinguish personal users more clearly from dealers, not a decision to legalize cannabis.
The published narcotic-drugs act still uses the ten-person definition. A proposed thirty-dose threshold or a hoped-for 2027 timetable should therefore not be presented as an operative personal allowance. Changes take effect through enacted legislation, not through an interview or consultation announcement.
Is Medical Cannabis Available?
Estonia permits regulated medical access, but this is not a general dispensary system. It is also incorrect to say that no cannabinoid medicine has marketing authorization. The State Agency of Medicines identifies Epidyolex, a prescription cannabidiol medicine, as authorized in Estonia.
For other cannabinoid medicines without local marketing authorization, the agency describes access on the treating doctor’s application when indicated and other treatment has been exhausted. The import and export guidance separately explains authorization requirements for unapproved medicines and controlled substances. The clinician’s request and the supplier’s import obligations should not be confused.
Epidyolex’s EU indications concern specific seizure disorders in patients aged two and older. Its authorization does not establish that cannabis is effective for every medical condition or authorize substitution with an ordinary CBD oil.
Availability, reimbursement, and eligibility need to be checked for the individual medicine. An old report about one patient between 2005 and 2016 cannot establish the number of people receiving cannabinoid treatment today.
Is CBD Legal?
CBD is not automatically lawful in every form or for every use. The medicines agency distinguishes CBD itself from controlled cannabis extracts and can classify a product as a medicine based on its characteristics. Agricultural hemp rules do not replace food, medicine, or other product requirements.
The Agriculture and Food Board’s current guidance states that CBD extracts are unauthorized novel foods and may not be marketed as food in Estonia or the EU. It also treats CBD oils in dropper bottles as unauthorized novel foods where consumption as a supplement can reasonably be expected.
Consequently, labeling an oil “for external use” or “technical” does not automatically avoid the food rules. The Board’s position is more specific than describing ingestible CBD as a general gray area. Check the actual composition, presentation, intended use, and authorization before buying or marketing a product.
New Cannabinoid Controls in August 2026
Estonia expanded controls on semisynthetic cannabinoids with effect from August 14, 2026. The Ministry of Social Affairs announcement explains that a group-based approach was adopted to address new chemically modified cannabinoids more effectively, rather than repeatedly adding individual substances.
The ministry describes their appearance in vaping liquids, treated plant material, resin-like products, and sweets. A product marketed as a new “legal cannabis alternative” should not be assumed lawful because it is different from conventional THC or was available before the change.
Can You Grow Hemp or Cannabis?
The medicines agency distinguishes EU-listed agricultural hemp varieties with THC not exceeding 0.3% from controlled cannabis. Qualifying hemp may be cultivated for agricultural purposes. Cultivating cannabis to produce a narcotic drug is prohibited.
The European Commission’s hemp guidance also explains the certified-seed and varietal requirements associated with Common Agricultural Policy support. Eligibility for support and the legality of a finished product are different questions.
There is no general recreational homegrow entitlement. Nor should an old count of approved varieties, a historical acreage ranking, or another country’s hemp production share be presented as a current measure of Estonia’s industry.
What This Means for Residents and Visitors
Small-quantity cannabis offenses remain punishable, medical access follows regulated pharmaceutical routes, and lawful hemp does not make every CBD product legal. Proposed penalty reforms and new cannabinoid controls must be assessed separately.
