Recreational cannabis is illegal in Montenegro. However, personal possession, supplying another person, licensed hemp cultivation and authorized medicines fall under different provisions. A guide that treats every possession case as trafficking, or says Montenegro has no hemp licensing rules, misses important parts of the law.

Is Recreational Cannabis Legal in Montenegro?

No. There is no legal adult-use cannabis retail market or general permission to grow marijuana at home. Montenegro has its own drug laws, and a product’s legality in a neighboring country does not determine its status here.

What Happens for Personal Possession?

Articles 45 and 52 of the Law on Prevention of Drug Abuse explicitly address unlawful possession for personal use as a misdemeanor, with a fine of €100 to €2,000. This is a statutory distinction, not simply informal police leniency.

The provision does not create a legal gram allowance. Evidence of sale, distribution or other conduct can change which offence applies. Readers should distinguish a prohibited act handled through misdemeanor proceedings from the more serious Criminal Code offences.

What Are the Supply and Trafficking Penalties?

Article 300 of the Criminal Code sets a basic two-to-ten-year imprisonment range for unauthorized production, processing and supply, including possession or transport for sale. Bringing drugs into Montenegro with the intent to commit that offence carries two to twelve years. Organized distribution networks and specified aggravated cases carry three to fifteen years.

Article 301 separately addresses enabling another person to use drugs, including giving someone a drug to consume or providing premises for that purpose. The basic range is six months to five years, rising to two to ten years in specified aggravated circumstances. Giving cannabis away can therefore create liability even when no money changes hands.

These are statutory ranges for different offences, not an automatic prison sentence for every person found with cannabis. The conduct, evidence and applicable circumstances matter.

Is Medical Cannabis Available?

Montenegro has not established a general medical-cannabis dispensary system. A 2022 proposal to allow cannabis oil for medical purposes was described as pending in the national drug situation overview published by the European Union Drugs Agency. That historical proposal should not be confused with an enacted right to buy cannabis oil.

It is nevertheless too broad to say that every cannabinoid medicine is necessarily inaccessible under all circumstances. Montenegro regulates pharmaceutical products through CInMED’s medicines framework, including the Law on Medicinal Products published in 2026. The position of a particular medicine depends on its authorization and any applicable import procedure. A clinician or pharmacist should confirm the exact product’s status with CInMED; approval in another country does not itself establish local access.

Can You Grow Cannabis?

There is no general personal marijuana-growing allowance. Unauthorized production can attract criminal charges. For example, police reported arrests in Nikšić in July 2026 after finding a suspected cannabis cultivation operation. That announcement concerned allegations, not a final conviction.

Licensed hemp cultivation is a separate matter. It should not be described as equivalent to growing marijuana for personal consumption.

Is Industrial Hemp Legal?

A licensing route exists. Article 18 of the drug-abuse prevention law permits hemp cultivation for food and industrial purposes, subject to authorization and a contract for purchase of the entire crop by a registered operator. Montenegro also publishes a rulebook specifying hemp cultivation applications and permits.

Variety restrictions matter. An order banning import and cultivation of Finola seed took effect on December 24, 2022. The government’s later upload date does not make this a new 2025 prohibition. The order cites the risk of THC exceeding 0.2% even though Finola appears in the EU variety catalogue.

Do not substitute the EU agricultural-support threshold of 0.3% for Montenegro’s own requirements. A crop permit also does not automatically authorize every product made from the plant.

Is CBD Legal in Montenegro?

A single answer based only on the letters CBD is inadequate. The exact substance, THC content, plant material and intended product category need checking. Montenegro’s Supreme State Prosecutor’s 2025 bulletin discusses the controlled-drug listing of cannabis and resin containing more than 0.2% THC. That does not establish that every product below that level is approved for food, cosmetic or medicinal sale.

Retailers and importers need to establish compliance for the particular product with the relevant health and customs authorities. A foreign seller’s certificate or an EU-market claim is not a substitute for Montenegro’s requirements. Patients should use the medicine-specific route rather than assume an ordinary CBD oil is an authorized treatment.

Can Travellers Carry Prescribed Medicines?

Article 43 provides a general rule for medicines containing controlled drugs: a personal-treatment quantity for up to 30 days, supported by the prescribed medical certificate or report, which must be no older than 90 days. This is not blanket permission to bring cannabis flower or any product advertised as medical cannabis.

Before travelling, confirm with Montenegro’s health and customs authorities that the exact medicine qualifies and that your documents meet the requirements. Foreign cannabis cards should not be treated as automatic authorization. Keep medicine in its original packaging with the relevant paperwork.

What Has Changed in Drug Policy?

The government adopted its 2024–2027 drug strategy in December 2024. It is no longer accurate to describe that strategy as merely being prepared. Its priorities include prevention, treatment, reducing supply and harm, and improving drug information systems.

In February 2026, the health ministry invited civil-society participation in work on the 2026–2027 action plan. These measures concern the national response to drugs; they do not create a recreational cannabis market. Changes to cannabis law require their own legislative basis.
