The Legal Status of Cannabis in Delaware

In the state of Delaware, recreational cannabis is decriminalized and considered to be a civil infraction. Medical use is however legal with both transportation and growing being allowed for this purpose.

Governor Jack Markell in May of 2011 signed into law legislation that allowed patients 18 and older suffering from “certain serious or debilitating conditions” to use medical cannabis as well as possess not more than six ounces. Apart from having a qualifying condition, patients need to obtain a Delaware Medical Marijuana Card for a fee of $125 which must be renewed once yearly. According to data obtained from the Delaware Division of Public Health data concerning patients that got their cards in 2015, 36.3% were treated for pain, 21.6% for muscle spasms, and 9.3% for cancer.

  • Severe debilitating pain which does not respond to conventional treatments for a period of over three months whose treatment cause serious side effects.

In the United States Under federal law, the possession and use of cannabis is illegal for any purpose as per the Controlled Substances Act (CSA) passed in 1970. It is classified as schedule I substance which lists it as having a high potential for abuse with no accepted medical benefit. In spite of this, many states have unilaterally legalized cannabis over the years for both medical and recreational purposes.
