Is CBD Legal in Illinois? (April 2024)

mm
Updated on

Yes, CBD is fully legal in Illinois. Residents can legally purchase and use hemp-derived CBD oil as long as specific requirements are met. These products must contain no more than 0.3% THC and must be manufactured within the state. If you suffer from qualifying medical conditions, possess a valid ID card, and have a medical marijuana card with a licensed physician's recommendation, you may also purchase marijuana-derived CBD oils.

One notable difference between CBD oils derived from marijuana and those derived from industrial hemp is that marijuana-derived CBD oils contain a higher level of THC, which can produce psychoactive effects.

Illinois CBD Laws

In August 2013, former Illinois Governor Pat Quinn signed the Compassionate Use of Medical Cannabis Pilot Program Act into law. This legislation legalized the cultivation, sale, and use of medicinal marijuana for residents suffering from specific severe medical conditions. The law has since been expanded, and Illinois has a list of permitted medical illnesses for which CBD is allowed. The state closely monitors cannabis from cultivation to final sale.

For patients with qualifying conditions such as HIV/AIDS, Parkinson's disease, cancer, and severe fibromyalgia, they can use marijuana-derived CBD under the state's medicinal marijuana program. Registered patients can possess up to 2.5 ounces of marijuana every two weeks, and they can also grow up to 5 marijuana or CBD-rich hemp plants at home. Those who need more must purchase from state-licensed medical marijuana dispensaries.

In 2014, the Cannabis Control Act established the Illinois Hemp Research Pilot Program, allowing the cultivation of industrial hemp for research purposes. Subsequently, the Illinois Department of Agriculture issued provisional regulations in 2019 under the Industrial Hemp Act, guiding the licensure, inspection, testing, sale, transfer, and transportation of industrial hemp.

Illinois CBD Possession Limits

There are no specific possession limits for CBD in Illinois. Patients registered under the state's medical marijuana program can possess up to 2.5 ounces of marijuana-derived CBD during a 14-day period.

Can Doctors Prescribe CBD Oil?

In Illinois, doctors cannot prescribe CBD oil directly, but they can recommend it to patients they believe will benefit from its use. The USFDA has not approved cannabis for medical use, so doctors are not allowed to prescribe hemp or marijuana CBD products. The exception is the drug called Epidiolex, a pure CBD product approved for use in children with certain seizure-related conditions.

Age Requirement to Buy CBD in Illinois

To purchase CBD in Illinois, you must be 21 years old or older. This age restriction applies to both hemp-derived and marijuana-derived CBD products.

Where to Buy CBD in Illinois

CBD products are available in various locations throughout Illinois. Marijuana-derived CBD with higher THC content can be found at licensed medical marijuana dispensaries, requiring a medical marijuana card for purchase. For hemp-derived CBD products, health food stores, head shops, smoke shops, vape shops, and online retailers offer a wide range of options. When buying CBD online, always choose reputable vendors who have their products tested by third-party laboratories to ensure quality and transparency.
