Cannabidiol (CBD) is “conditionally legal” in Ohio. Governor Mike DeWine gave his endorsement to Senate Bill 57 on July 30, 2019, which legalized hemp and hemp-derived products, including CBD, in Ohio. The bill mandates the Ohio Department of Agriculture (ODA) to regulate the production and cultivation of hemp. Senate Bill 57 decriminalized hemp and authorized licensed hemp production within the state. According to this legislation, universities in Ohio can engage in hemp research and processing without needing licenses. Ohio residents are not required to obtain licenses to possess, sell, or purchase hemp or hemp products.

Ohio CBD Possession Limits

State Bill 57 does not specify the possession limits or age restrictions for individuals carrying, buying, or selling CBD products in Ohio. However, dispensaries generally sell CBD to individuals who are at least 18 years old.

Can Doctors Prescribe CBD in Ohio?

Yes, under House Bill 523, physicians are permitted to recommend medical marijuana, including marijuana-derived CBD oil and other CBD products, to patients with specific medical conditions in Ohio. However, doctors must first obtain certificates of recommendation from the State Medical Board of Ohio. The qualifying medical conditions for CBD oil recommendation in Ohio include HIV, Alzheimer's disease, cancer, Crohn's disease, glaucoma, hepatitis C, fibromyalgia, multiple sclerosis, inflammatory bowel disease, epilepsy, pain, Parkinson's disease, ulcerative colitis, traumatic brain injury, post-traumatic stress disorder (PTSD), Tourette's syndrome, and sickle cell anemia.

Age Requirement to Buy CBD in Ohio

Ohio does not establish a minimum age for purchasing CBD products. However, CBD stores and dispensaries in the state often enforce age restrictions for their customers. Some vendors may require CBD buyers to be over 18 years old, while others, such as smoke shops, may set a minimum age of 21 years.
