Is Weed Legal in Lithuania? Understanding Lithuania Cannabis and Marijuana Laws (2026)

Recreational cannabis is illegal in Lithuania, and unauthorized possession remains a matter of criminal law even when the quantity is small. Prescription cannabinoid medicines and regulated industrial hemp fall under different frameworks. Neither creates a general right to buy recreational cannabis, grow intoxicating varieties at home, or sell CBD food supplements.

Is Recreational Cannabis Legal in Lithuania?

No. Lithuania has no general adult-use cannabis retail system. Its Criminal Code distinguishes unauthorized possession without intent to distribute under Article 259 from distribution-related offenses under Article 260. A small quantity is not a lawful personal allowance.

Has Cannabis Been Decriminalized?

Proposals to replace criminal penalties for small-quantity possession with administrative sanctions have not created a general decriminalization rule. In December 2022, parliament advanced one part of a reform package but did not pass the corresponding Criminal Code change; the draft went back to committee. Announcements that a proposal has been introduced, considered, or approved at an intermediate stage should not be treated as an enacted change. The operative possession provisions still distinguish a criminal misdemeanor involving a small quantity from other unauthorized possession.

What Are the Penalties?

Under Article 259, unauthorized possession and related handling without intent to distribute can attract criminal penalties. For a small quantity, the listed sanctions include community service, a fine, restriction of liberty, or arrest. The broader possession provision permits imprisonment of up to two years; the outcome depends on the offense and circumstances.

Consumption without a doctor’s prescription is treated separately under administrative law. An administrative penalty for use does not make the possession that preceded it lawful. Supply and trafficking involve different provisions and potentially more serious consequences.

Quantity thresholds help classify an offense; they are not permission to carry cannabis below a particular weight. This is why an old comparison describing a 0.25-gram resin threshold should not be used as a practical safe limit.

Article 259 also contains a specific exemption involving voluntary medical help or voluntary surrender of substances held without distribution intent. Its conditions concern particular conduct and substances. It should not be read as blanket immunity for every drug offense simply because someone later hands over a product.

Are Cannabis-Based Medicines Available?

Lithuania’s pharmaceutical pathway is distinct from a dispensary-style medical cannabis program. It is inaccurate to describe all cannabinoid medicine access as nonexistent. The Lithuanian medicines register lists Epidyolex, a prescription cannabidiol oral solution at 100 mg/ml, with an EU registration date of September 19, 2019.

The European Medicines Agency’s authorization covers specified seizure disorders in patients aged two and older: Lennox-Gastaut and Dravet syndromes in conjunction with clobazam, and tuberous sclerosis complex as an additional treatment. This does not establish a general cannabis treatment entitlement for cancer, HIV, chronic pain, or every form of epilepsy.

Registration, a suitable prescription, reimbursement, and stock at a particular pharmacy are separate questions. Patients should ask their treating specialist and pharmacist about their actual medicine and circumstances. Retail CBD oil is not interchangeable with a regulated prescription cannabidiol medicine.

Is Industrial Hemp Legal?

Yes, within the regulated fibre-hemp framework. The Lithuanian food regulator, VMVT, distinguishes hemp plants with THC not exceeding 0.3% from finished-product requirements. Its guidance describes a general 0.2% limit for finished hemp products, with lower category-specific limits applying to food. The calculation includes delta-9-THC and its acid precursor as specified in the rules.

These are different measurements and legal categories. A plant meeting the field threshold does not make every extract, drink, or food made from it lawful. Producers must also meet the applicable testing, documentation, and product rules.

A further change took effect on July 1, 2026. The Seimas’s announcement of the amendment explains that Lithuanian producers may export hemp products meeting the destination country’s permitted THC levels. Products made under that export provision are not thereby authorized for the Lithuanian domestic market.

Can You Grow Cannabis at Home?

There is no general right to grow intoxicating cannabis for personal recreational use. However, saying that every cannabis plant is prohibited outside a small group of licensed commercial farms is also too broad.

The State Plant Service’s hemp guidance describes a specific horticultural category: regulated fibre hemp grown among or beside other garden plants for agrotechnical or phytosanitary purposes. It specifies a maximum area of 0.1 hectare and up to 20 plants per 0.01 hectare, with approved varieties, certified seed, and notification requirements. Horticultural growers may not place their hemp products on the market.

That narrowly defined hemp provision is not a recreational homegrow exemption. Growers should check the Plant Service’s current requirements before planting.

Is CBD Legal in Lithuania?

There is no single answer covering every CBD product. A medicine, a food supplement, and a cosmetic are regulated differently. Nor is a blanket “zero detectable THC” rule an accurate summary of every hemp-product category.

VMVT states that foods and supplements containing CBD-rich hemp extracts require novel-food authorization before marketing. Its March 2026 explanation of the updated EFSA assessment emphasizes the distinction between a scientific safety assessment and authorization to sell a food product.

A label describing an extract as “technical,” “not for consumption,” or “THC-free” does not by itself establish compliance with all the rules that apply to its composition and intended use. Check the actual product category and the relevant authority’s requirements instead of relying on an online seller’s general claim that CBD is legal throughout Europe.

What Should Travelers Check?

Do not assume that a foreign prescription or a legal purchase elsewhere automatically permits entry with a cannabis product. Lithuanian Customs’ medicine guidance sets out documentation and quantity requirements, including special rules for controlled medicines. Confirm the requirements for the exact medicine and route before traveling.

The practical distinction is between prohibited recreational cannabis, regulated prescription medicines, and compliant hemp products. Assessing them separately avoids both overstating legalization and incorrectly dismissing legitimate medical or agricultural pathways.
