Is Weed Legal in Slovakia? Understanding Slovakia Cannabis and Marijuana Laws (2026)

Recreational cannabis is illegal in Slovakia, and unauthorized possession can still be a criminal offense even at a low quantity. However, the current Criminal Code uses separate provisions for possession, personal cultivation and supply. Its quantity-based framework should not be confused with the older rules expressed in multiples of a single dose.

Slovakia also distinguishes illicit cannabis from permitted industrial hemp and regulated medicines. CBD’s removal from the psychotropic-substance list did not authorize every CBD food, oil or flower product.

Is Recreational Cannabis Legal in Slovakia?

No. Slovakia has no legal adult-use retail market or recreational home-grow allowance. The current Criminal Code continues to punish unauthorized possession, cultivation and supply.

The law does distinguish cannabis from other drugs in some provisions: negligible-quantity cannabis possession has a lower maximum than the corresponding offense involving other controlled drugs. Saying that Slovak law makes no distinction between drug types is therefore inaccurate. The rules also differ substantially from those in neighboring Czechia.

What Are the Current Possession Penalties?

Section 171 provides these penalty ranges for unauthorized possession:

  • Negligible quantity of cannabis, cannabis resin or a THC-containing psychotropic substance: up to one year in prison.
  • Small quantity: six months to three years.
  • A greater quantity, or a qualifying prior conviction within the preceding 24 months: one to six years.

These are statutory classifications and ranges, not a prediction that every conviction produces immediate imprisonment. More serious quantities or conduct can fall under other provisions.

What Counts as a Negligible Quantity?

Annex 1 of the Criminal Code lists 2 grams of dried marijuana and 2 grams of cannabis resin/hashish as the material thresholds, alongside a 200-milligram active-substance threshold. Section 135c explains how these figures interact: if the material weight exceeds the listed amount, active-substance content determines whether the quantity remains negligible or becomes small.

“Small” generally extends above negligible quantity up to five times the listed material threshold, subject to that active-substance rule. Mixed substances and combined possession and cultivation have additional rules. Two grams is not a legal possession allowance, and the table should not be applied to every oil or edible without examining its classification.

Can You Grow Cannabis at Home?

There is no lawful recreational plant allowance. Nevertheless, personal cultivation has its own offense under section 172; it is not automatically treated as manufacture or trafficking regardless of circumstances.

Unauthorized cultivation of a negligible quantity of cannabis solely for personal consumption, with none intended for distribution or financial benefit, carries up to six months. Annex 2 defines that category as no more than two plants, excluding the specified permitted hemp varieties. A small quantity carries up to two years, with higher ranges for larger quantities and aggravating circumstances. These lower penalties do not legalize the plants.

What About Manufacturing or Selling Cannabis?

Section 173 separately addresses unauthorized manufacture and trading. Even a negligible quantity carries a one-to-five-year range, with substantially higher penalties for specified larger quantities or aggravated conduct. Sharing, distribution intent and other circumstances can change the applicable offense; personal-possession figures should not be used to assess a supply case.

Is Medical Cannabis Legal in Slovakia?

Slovakia has no general patient-access program for cannabis flower. That is different from saying that every cannabis-based medicine is illegal. The Slovak medicines regulator lists Sativex oral spray as registered. Its approved product information concerns treatment of multiple-sclerosis-related spasticity under specified conditions.

The cannabidiol medicine Epidyolex also has EU authorization for specified seizure disorders. Registration does not guarantee local stock, reimbursement or eligibility for an individual patient. A doctor and pharmacy should verify the exact medicine and lawful supply route.

The controlled-substances law permits licensed cannabis cultivation for research under specific conditions. A research permit is not a patient cultivation authorization.

Is Industrial Hemp Legal?

Yes, subject to the national framework. Section 15 defines industrial cultivation in terms of obtaining fiber and seed. It expressly exempts cultivation of varieties in the EU common agricultural variety catalogue, including a variety listed when sown, from the ministry cultivation permit otherwise required by that law.

Accordingly, it is inaccurate to say that every hemp grower needs that permit. Other agricultural requirements can still apply, and processing or manufacturing may need separate authorization. The EU’s 0.3% THC condition for agricultural support should not be presented as a general retail-product legalization rule.

Is CBD Legal in Slovakia?

Law 124/2021 removed CBD from Slovakia’s psychotropic-substance list effective May 1, 2021. This removed that particular control on CBD; it did not approve all products containing it.

Ingestible CBD is subject to EU novel-food authorization requirements. Slovakia’s parliamentary analysis explains the resulting restriction on marketing unauthorized CBD foods and supplements. Cosmetics and medicines follow their respective product rules, while THC and other controlled ingredients must also be considered.

In February 2026, the Agriculture Ministry reported EFSA’s revised CBD safety assessment. A safety assessment is not a market authorization. Product legality cannot be inferred simply from a “CBD” label or sale on a foreign website.

Are HHC and Related Cannabinoids Legal?

HHC is controlled. The current Slovak schedules also list H4-CBD, HHC-H, HHC-O, HHC-P and HHCP acetate, among other substances. CBD’s delisting does not extend to these separately controlled compounds. Retail marketing as a cannabis alternative does not establish legality.

Final Thoughts

Slovakia continues to prohibit recreational cannabis while allowing specific hemp activities and regulated medicines. For residents and visitors, the relevant questions are the exact substance, quantity, activity and authorization. A foreign purchase or prescription does not by itself establish permission to carry a cannabis product into Slovakia.
