Is Weed Legal in Czechia? (April 2024)
Yes, medical cannabis is legal in the republic of Czechia, but recreational use is prohibited. Czechia has liberal cannabis laws and last year the country announced that it is making plans to legalize recreational cannabis.

Medical Cannabis in Czechia
Medical cannabis was legalized in Czechia in January 2013 through a parliamentary process. In the first year the government only allowed imported cannabis to be given to patients to ensure that the right standards were in place. Currently, domestic production of cannabis is allowed under strict supervision. Patients require a prescription from a specialized physician to be able to access medical cannabis from a pharmacy. The maximum amount of cannabis that can be prescribed for each patient per month is 180g of cannabis by dry weight.
Is Cannabis Decriminalized in Czechia?
Yes, Czechia decriminalized cannabis in 2010 and since then possession of no more than 15g of cannabis is considered as a civil and not criminal offense. Growing no more than 5 plants has also been decriminalized. Such offenses attract a fine of 15,000CZK but most times lower fines are given. Trafficking cannabis is still a criminal offense that’s punishable by a prison sentence that ranges from 2 years for minor trafficking to 18 years for major trafficking.
Is Recreational Cannabis Legal in Czechia?
No, recreational cannabis is yet to be legalized in Czechia. However, the illicit market for cannabis is vibrant and it is easy to get cannabis off the high street.
Is Hemp Legal in Czechia?
Yes, hemp is legal in Czechia. Industrial hemp in Czechia should not exceed 1% THC. Cultivation of industrial hemp is also permitted but it is highly regulated. Cultivation of more than 100 m2 requires statutory authorization failure to which will attract an administrative fine not exceeding CZK 1,000,000 (approx. EUR 40,800).
Is CBD Legal in Czechia?
Yes, hemp-derived CBD is legal in Czechia but the laws are conflicting. Czech requires that all CBD products comply with the 0% THC standard. CBD is considered as a “novel food” Pursuant to (EU) 2015/2283 European Parliament Regulation. This means that CBD products require a special authorization before they can be put out on the market. Most of the CBD products in the Czechia market fail to meet such standards.
Can I Grow Cannabis in Czechia?
Even though cultivation of cannabis is illegal in Czechia, the cultivation of not more than 5 plants has been decriminalized.
Did Czechia Ban CBD?
Last week, the Czech republic announced a ban on hemp-derived CBD products due to “ lack of scientific studies on their effects on human health.” The Ministry of Agriculture is preparing a measure that will remove all forms of hemp-derived CBD from the market including oils, tinctures, capsules, gummies and other edibles. The ban also includes cosmetics that contain hemp-derived cannabinoids. This is ironic because Czechia is making plans to legalize recreational cannabis.
