Is Weed Legal in Albania? Understanding Albania Cannabis and Marijuana Laws (2026)
Recreational cannabis is illegal in Albania. The country permits controlled medical and industrial cannabis production for export under Law No. 61/2023, but this has not created a domestic recreational market or a medical-marijuana dispensary program.
There is also an important qualification to possession rules: the Criminal Code expressly excludes qualifying small doses held for personal use from the ordinary possession offense. That limited exception is not a right to buy cannabis, grow it at home or bring it across the border.
Is Recreational Cannabis Legal in Albania?
No. The National Agency for Cannabis Control explains that general cannabis use has not been legalized. The regulated production framework covers specified medical and industrial activities, with products intended for export. A cultivation license therefore does not authorize a retail dispensary serving residents or tourists.
Albania’s Balkan neighbors also have separate national rules. Crossing from Montenegro or Greece does not carry any cannabis permission into Albania.
The Small Personal-Use Possession Exception
Article 283 of the Criminal Code contains an explicit exception for personal use and small doses. It is inaccurate to say that this exception is merely informal or that every possession incident is necessarily a crime. Both the purpose and quantity matter, and the provision does not set a universal three-gram allowance.
The distinction can still require investigation. In its review of 2024 work, the Durrës prosecutor’s office highlighted unnecessary referrals involving small personal-use quantities and urged better differentiation between users and distributors. A person’s assertion of personal use does not settle the legal classification, and supplying another person is a different issue.
Penalties for Unlawful Supply and Trafficking
Article 283 provides a basic prison range of five to ten years for the prohibited conduct it covers, including possession outside the personal-use small-dose exception. Specified aggravated cases carry seven to fifteen years, while organizing, directing or financing the activity carries ten to twenty years.
Article 283/a separately addresses unlawful import, export, transit and trafficking, with a basic range of seven to fifteen years and higher penalties for aggravated conduct. These statutory ranges should not be presented as automatic sentences for every traveler or every quantity.
What Did the Medical Cannabis Law Change?
Law No. 61/2023, approved on July 21, 2023, established controlled cultivation, processing, transport and export pathways. Article 5 prohibits domestic retail or wholesale sale, distribution, acquisition and consumption of medical cannabis products covered by the law. Article 29 directs domestically produced medical products and by-products solely to export.
This is a production law, not a general patient-access program. Its export authorization should not be read as permission for residents to purchase locally produced flower or oils. Questions about an individual pharmaceutical medicine must be addressed to the Albanian medicines authorities rather than answered by assuming that every medicine and every cannabis product has identical status.
How Medical Cannabis Licensing Works
The law requires substantial experience, capital, security and traceability. Medical licenses can run for 15 years, with renewal subject to the applicable procedure and conditions reviewed every three years. The cultivation framework specifies units of 5–10 hectares, up to four adjacent units per license, and a nationwide medical cultivation ceiling of 200 hectares.
Article 15 requires three years’ experience in at least three principal activities. The applicant or qualifying 51% shareholder must meet additional requirements, including five years producing cannabis by-products in an OECD country, the specified good-manufacturing-practice history and capital of at least 100 million Albanian lek.
The application fee is 100,000 lek. After the third year, the statutory annual fee is 1.5% of turnover with a minimum of 10 million lek. These are lek-denominated obligations; approximate euro conversions should not replace the legal amounts. Other requirements include a bank guarantee, qualified personnel and approved security arrangements. Applicants should obtain the current documentation from the regulator’s application package.
What Changed in the Rollout During 2026?
Implementation has continued beyond the initial 2025 cultivation and security rules. On July 22, 2026, the government adopted Decisions 593 and 594 addressing cannabis marking, traceability and related fees.
On July 30, 2026, it approved Decision 630 on the national register. The register is designed to connect licensing and permits with cultivation, processing, transport, export, inspections and enforcement records. The agency reported work with the national information-society agency on implementation in August.
These are regulatory milestones. They do not, by themselves, demonstrate that all permitted land is planted, that a particular applicant has received a license or that commercial exports have begun. Land zoning, an application, an awarded license and an operating production site are different stages.
Is Industrial Hemp Legal?
Industrial cultivation is permitted within the 2023 framework. Its definition covers qualifying varieties with no more than 0.8% THC. Industrial permits run for five years, with renewal provisions, and cover areas of at least one hectare.
This is a separate permit route from medical licensing. Article 23 refers to registration documentation for a farmer, legal person or natural person, so the medical-company requirements should not be indiscriminately applied to every industrial applicant. The regulator’s legislation list includes the March 6, 2025 cadastral-zone decision and subsequent industrial export rules.
The 0.8% cultivation definition is not a consumer-product safe harbor. It does not authorize retail marijuana, home-grown recreational cannabis or unrestricted CBD imports.
Is CBD Legal in Albania?
The cultivation framework does not establish an unrestricted consumer CBD market. Medical by-products and final products produced under it are subject to the export requirements, while industrial products follow their own permitted activities and product rules.
CBD oils, foods, cosmetics and medicines should not be treated as interchangeable legal categories. A foreign website selling a product into Albania does not establish permission to import or market it. The exact composition, intended use and applicable authorization must be checked with the Albanian authorities.
Can You Grow Cannabis at Home?
There is no personal recreational home-grow allowance. Legal medical or industrial cultivation requires the relevant license or permit and compliance with its conditions. Owning land, buying seeds or selecting a low-THC variety does not replace that process.
Can Travelers Bring Cannabis or Prescribed Medicines?
Do not treat a foreign cannabis card, prescription or legal purchase abroad as automatic permission to enter Albania with cannabis. Unlawful import is a separate trafficking offense, and the small personal-use possession exception is not a border allowance.
At the same time, the claim that Albania never accepts foreign prescriptions for medicines is too broad. The Foreign Ministry’s general medicine guidance provides for personal-use medication accompanied by documentation from a prescribing doctor, including a foreign doctor, and a declaration deposited with customs. This general guidance does not specifically authorize cannabis products. Obtain confirmation for the exact medicine and any additional controlled-drug requirements before travel.
Final Thoughts
Albania is building a regulated export industry while maintaining its prohibition on a domestic recreational market. For readers, the essential distinctions are between a small-dose possession exception and legalization, between medical production and patient access, and between industrial permits and unrestricted retail products.
