Is Weed Legal in Venezuela? Understanding Venezuela Cannabis and Marijuana Laws (2026)
Venezuela has no legal recreational cannabis market. Its drug law distinguishes unauthorized supply and possession from a separate procedure for people found to be consuming a personal dose. That procedure can involve compulsory treatment and court supervision; it is not permission to buy, grow, or travel with cannabis.
What Law Governs Cannabis in Venezuela?
The principal statute is the Organic Law of Drugs, which the National Assembly lists as in force. It originally took effect on September 15, 2010, and was reprinted with corrections, most recently in Official Gazette 39,546 of November 5, 2010. It covers controlled substances, authorized activities, criminal offenses, and measures applied to consumers.
The law should not be summarized as a ban on every medical or scientific use of every controlled substance. Article 37 recognizes properly authorized activities for medical treatment, lawful medicine production, and scientific research. Those general provisions do not establish a public medical cannabis dispensary system or authorize a particular cannabis product.
Is Personal Possession Decriminalized?
Venezuela provides a distinct personal-consumption procedure, but describing it simply as a legal 20-gram allowance is misleading. Articles 130 and 131 address consumers and personal doses, with the judge considering forensic evidence and individual circumstances, including consumption patterns and the nature of the substance.
Article 153 sets a one-to-two-year prison term for illicit possession for purposes other than authorized activities or the personal consumption covered by Article 131. It refers to quantities up to 20 grams of marijuana and up to 5 grams of what the statute calls genetically modified marijuana. These figures occur within the unlawful-possession provision; they are not an unconditional right to carry those amounts.
A court’s assessment of a personal dose is distinct from merely weighing a package. The statute also rejects stockpiling beyond a theoretical personal dose as a way to claim the possession treatment. Quantity, purpose, and the applicable offense all matter, so the one-to-two-year range should not be presented as the standard punishment for any amount above 20 grams.
What Happens Under the Consumption Procedure?
Article 141 describes referral to the Public Prosecutor’s Office, toxicological and substance testing, and subsequent medical, psychiatric, psychological, and social examinations. Once consumption is established, specialists’ recommendations inform the compulsory treatment and social measures imposed by the court.
Article 130 provides for mandatory rehabilitation treatment in a specialized center, with possible reintegration, monitoring, or community service measures. Other provisions address noncompliance and repeated consumption. This process has consequences even where the person is not convicted of trafficking.
The law also provides procedural protections. Article 147 says people retained for the consumption examinations must not be held with people detained for criminal offenses and addresses their separation if they must temporarily remain at a detention facility. Those written protections should not be confused with a guarantee that an encounter will involve no detention or disruption.
What Are the Penalties for Supply and Cultivation?
The official law text separates several offenses and quantity bands. For example:
- Trafficking: Article 149 provides a general 15-to-25-year prison range, with separate lower quantity bands carrying 12-to-18-year or 8-to-12-year ranges. Directing or financing these operations carries a separate higher range.
- Illicit manufacture or production: Article 150 provides a 15-to-20-year range, with higher penalties for directing or financing the activity.
- Illicit cultivation and specified seed, resin, or plant activities: Article 151 provides a general 12-to-18-year range. It provides a 6-to-10-year range when the seeds or resin do not exceed 300 grams, or the plants do not exceed 10, with an additional rule for genetically modified marijuana.
These are statutory ranges, not predictions of a sentence in an individual case. Aggravating circumstances and other provisions can change the result. In particular, the reference to 10 plants is a penalty threshold, not a home-growing allowance.
Is There a Medical Cannabis Program?
The official materials reviewed did not establish a dedicated patient-registration and medical cannabis retail program comparable to those in several neighboring countries. Patients should not assume that a doctor’s recommendation, a diagnosis, or a foreign medical cannabis card gives them permission to obtain or possess an otherwise unauthorized product.
At the same time, the law contains general pharmaceutical authorization provisions. Article 37 addresses lawful medical and scientific activities, while the import, manufacture, and distribution sections require the relevant permissions. It would therefore be too broad to say the statute makes every possible cannabis-based pharmaceutical authorization legally impossible. Whether a specific medicine is approved and available requires confirmation from the competent health authority.
Can You Grow Cannabis or Industrial Hemp?
There is no general personal or medical home-growing entitlement in the law. Article 57 permits cultivation of plants with psychoactive principles for scientific research by people properly authorized and supervised by the health ministry. That is a limited authorization route, not permission for an individual to start a crop simply by calling it research.
The reviewed official materials did not establish a separate commercial low-THC hemp licensing system or a general THC threshold exempting hemp cultivation. Calling a plant hemp does not establish that growing it is permitted. Likewise, cultivation rules alone do not settle the customs classification or admissibility of every finished fiber or seed product.
What About CBD Products?
A CBD label is not evidence of Venezuelan regulatory approval. The law regulates substances through its definitions, treaty schedules, and competent authorities’ classifications; it does not provide a general retail exemption for products advertised as CBD, hemp-derived, or low in THC.
The sources reviewed did not establish an open, authorized consumer CBD market. A particular oil, cosmetic, edible, or medicine needs to be assessed for its composition, classification, and applicable approvals. Avoid treating online availability or legality in another country as proof that sale or import is permitted in Venezuela.
Can Visitors Bring Cannabis Into Venezuela?
Visitors should not rely on the personal-consumption provisions as an import exemption. The law treats imports and other controlled-substance transactions separately, and a foreign prescription or medical card does not by itself supply Venezuelan authorization.

How Does Venezuela Compare With Its Neighbors?
Colombia, Argentina, Brazil, and Peru have distinct regulated medical pathways and their own possession rules. None of those neighboring systems extends permission into Venezuela.
The National Assembly’s current law listing provides the starting point for checking reform. Political statements or developments elsewhere do not change the Venezuelan statute, and they cannot establish when future legalization might occur.
