Is Weed Legal in Paraguay? Understanding Paraguay Cannabis and Marijuana Laws (2026)
Paraguay permits medical cannabis through a regulated national program and authorizes industrial hemp production. Recreational cannabis remains illegal. Its often-cited 10-gram possession rule is a limited exemption for personal use, subject to medical assessment, rather than permission to buy, sell, or cultivate marijuana.
A medical pilot introduced in December 2025 expands access to certain cannabis-derived products, but it still requires registered patients, qualified prescribers, controlled prescriptions, and authorized suppliers. Neither that pilot nor the industrial hemp program creates a general right to grow cannabis at home.
Is Medical Cannabis Legal in Paraguay?
Yes. Law 6007/2017 established PROINCUMEC, Paraguay’s national program for the medical and scientific study of cannabis and its derivatives. DINAVISA, the National Directorate of Health Surveillance, administers the program. Production, manufacture, patient access, and dispensing operate within a system of health and drug-control authorizations.
The original implementing framework was Decree 9303/2018. Decree 7761/2022 subsequently changed licensing provisions, including how authorized production zones are determined. That amendment should not be described as eliminating all geographic controls: it gives the competent authorities responsibility for establishing the zones.
The distinction between a legal medical program and an unrestricted cannabis market matters. A patient’s medical need does not independently authorize cultivation, commercial supply, or possession of any product sold as cannabis medicine.
What Changed Under the Medical Cannabis Pilot?
DINAVISA Resolution 488/2025, issued on December 19, 2025, regulates an exceptional, temporary pilot for medicinal products combining THC, CBD, or other cannabinoids. It follows Health Ministry Resolution S.G. 902/2025. The pilot is set for two years from the resolution’s date; an extension requires technical evaluation rather than occurring automatically.
Eligible manufacturers must already hold the relevant production and industrialization licenses. The rules require traceability from plant material to finished product, manufacturing and quality controls, reporting, and monitoring of adverse reactions. The pilot’s exceptional product pathway is not a waiver of those safeguards.
Patients must be enrolled in PROINCUMEC. Prescribers must have a valid professional registration, be registered with the program, and be specialists in the condition being treated. The resolution allows prescribing within the doctor’s own specialty for qualifying refractory conditions; it does not allow any physician to prescribe for every condition.
Products supplied under this pilot require a quadruplicate prescription. The prescription must identify the patient and diagnosis and specify the preparation, administration, quantity, and treatment period. Dispensing is restricted to authorized pharmacies and dispensaries. A low THC concentration alone is not a reason to bypass the pilot’s prescription requirements.
The resolution names several refractory conditions and symptoms within its scope. Legal eligibility should not be confused with proof that cannabis is effective for every patient or diagnosis. Treatment selection and follow-up remain the clinician’s responsibility.
Is Recreational Cannabis Legal in Paraguay?
No. The medical framework does not establish a recreational retail market or a tourist exemption. Paraguay’s government reiterated this distinction when explaining the pilot in February 2026: the changes regulate therapeutic access and do not authorize recreational consumption or personal cultivation.
Buying from an unauthorized seller, supplying another person, and growing plants raise separate legal issues from personal possession. The fact that a small personal quantity may qualify for an exemption does not make the supply chain lawful.
What Does Paraguay’s 10-Gram Possession Rule Mean?
Article 30 of Law 1340/1988 exempts possession of prescribed drugs from punishment. It also provides an exemption for possession exclusively for personal use, with the quantity limited to what is necessary for daily consumption.
For the personal-use exemption, the law calls for assessment by a forensic doctor and a specialist designated by the Health Ministry. The person concerned may also appoint a medical expert. Ten grams is the statutory maximum for marijuana within that assessment; it is not an unconditional allowance for every person or circumstance.
Article 30 provides imprisonment of two to four years and confiscation for possession exceeding the prescribed quantity or the amount necessary for personal use. Sale, distribution, cultivation, and other conduct are governed by separate provisions. Exceeding 10 grams should therefore not be presented as automatically proving trafficking, although it can expose a person to criminal proceedings.
Can You Grow Cannabis at Home?
The medical pilot does not authorize patients to grow their own marijuana. Its production pathway runs through licensed operators, with controls over cultivation and the resulting medicines. Patient registration and a prescription do not substitute for a production authorization.
Industrial hemp is also an authorized agricultural activity, not a general household exemption. A family participating in an approved hemp project is in a different legal position from someone planting cannabis at home without authorization. Do not interpret references to Paraguay’s family-farming hemp sector as permission for any household to grow plants.
Is Industrial Hemp Legal in Paraguay?
Yes, within the authorization framework established by Decree 2725/2019. Paraguay distinguishes non-psychoactive cannabis containing less than 0.5 percent THC on a dry-weight basis from psychoactive cannabis at or above that threshold. Meeting a chemical threshold does not, by itself, authorize cultivation or commercial activity.
The Ministry of Industry and Commerce’s industrial hemp application guidance describes applications submitted through the Ministry of Agriculture and Livestock, assessed through the relevant interagency process, and approved for five years. Applicants must meet the required legal, technical, environmental, and project conditions.
Prospective growers should confirm the current cultivation area, location, seed, reporting, and supply-chain requirements for their actual project with the responsible authorities. A permitted area mentioned in an individual program should not be treated as a nationwide allowance for unregistered cultivation.
Is CBD Legal in Paraguay?
CBD can be supplied through Paraguay’s regulated medicinal-product pathways, subject to the applicable product authorization, patient, prescription, and dispensing requirements. The December 2025 pilot specifically covers combined cannabinoid preparations and requires quadruplicate prescriptions for its products.
It is therefore misleading to say that every CBD product automatically qualifies for a simple prescription or unrestricted sale. A registered medicine, a preparation supplied under the pilot, and an industrial hemp product can fall under different requirements. A CBD label or low THC content does not establish that a food, cosmetic, supplement, or imported oil is approved for sale.
Patients should ask the prescriber and authorized pharmacy which regulatory pathway applies to the particular product. Understanding where CBD comes from does not replace checking its local authorization.
What Should Visitors and Patients Check?
Before obtaining or traveling with cannabis medicine, confirm the product’s status with DINAVISA and the relevant border authorities. Do not assume that an overseas prescription or medical cannabis card authorizes importation, purchase, or possession in Paraguay. Documentation and permission must match the activity involved.
Rules also differ across neighboring Bolivia, Argentina, and other South American countries. A product’s lawful purchase in one country does not establish a right to carry it across a border.
Will Paraguay Legalize Recreational Cannabis?
The medical pilot provides a concrete route for evaluating regulated therapeutic access. Its temporary character and continuing controls should not be interpreted as a scheduled transition to recreational legalization. Future proposals would need to be assessed on their actual legislative status.
For now, the practical distinctions remain clear: medical access requires the appropriate approvals, industrial hemp requires authorization, and the personal-possession exemption does not legalize recreational supply or home cultivation.
