Pennsylvania’s Medical Marijuana Program
Pennsylvania’s Medical Marijuana Program was created by the Medical Marijuana Act, signed into law on April 17, 2016, and codified at 35 P.S. §§ 10231.101 through 10231.2110, according to the Department of Health’s program page. Pennsylvanians with one or more of 24 qualifying serious medical conditions are eligible to participate, and all patients must obtain a certification from an approved practitioner confirming the condition for which they are being treated. The act requires the program to maintain patient and practitioner registries and an electronic tracking system covering medical marijuana from seed to sale. The program’s final-form regulations were posted in the Pennsylvania Bulletin on March 4, 2023.
The department’s dispensary guidance states that permits were initially issued for no more than 50 dispensaries, with each dispensary permitted up to three separate locations, and that an applicant must apply for and be awarded a permit before dispensing medical marijuana. The application requires a non-refundable initial fee of $5,000, a permit fee of $30,000 that is refundable if the permit is not granted, and proof of $150,000 in capital. Applicants must also provide a description of their business organization and activities, show an ability to maintain effective security and control to prevent diversion, abuse, or other illegal conduct, submit evidence of compliance with municipal zoning requirements, and provide a diversity plan. Permit recipients must complete a two-hour training course.
Department of Health data presented to the Medical Marijuana Advisory Board on June 24, 2026 showed 438,727 active patient certifications, 1,937 approved practitioners, and 1,129,606 program-to-date patient registrations as of June 1, 2026. The presentation recorded 196 operational dispensaries and 33 operational grower/processors statewide, with $9.6 billion in program-to-date sales. It also reported $2,268,338 in Medical Marijuana Assistance Program Phase 3 financial benefit given. Monthly dispensary sales for 2026 recorded in the presentation included $153 million in January and $158 million in May, and the department’s dry-leaf pricing series put the retail price at $7.49 per gram and the wholesale price at $2.80 per gram through May 2026.
The department’s list of medical marijuana dispensaries in Pennsylvania with product, current as of September 16, 2026, records the Gettysburg dispensary at 19 Baltimore Street, listed with Curaleaf’s website, as having medical marijuana available beginning August 7, 2018. The same list records other operating York dispensaries, including Organic Remedies on Haines Road, Zen Leaf on Loucks Road, Trulieve on East Market Street, and RISE on White Street.
